Page 412, after line 51, insert:

"7. The Department of Human Resource Management, shall include language in state employee health plan contracts, requiring the contractor to report to the department for all pharmacy claims: the amount paid to the pharmacy provider per claim, including but not limited to the cost of drug reimbursement; dispensing fees; copayments; the amount charged to the contractor for each claim by its pharmacy benefit manager; and the amount charged by the contractor to the Commonwealth. In event there is a difference between these amounts, the contractor shall report an itemization of all administrative fees, rebates, or processing charges associated with the claim.  All data and information provided by the contractor shall be kept secure; and notwithstanding any other provision of law, the department shall maintain the confidentiality of the proprietary information and not share or disclose the proprietary information contained in the report or data collected with persons outside the department. Only those department employees involved in collecting, securing and analyzing the data for the purpose of preparing the report shall have access to the proprietary data. The department employees shall provide a report using aggregated data only to the Governor and the Chairmen of the House Appropriations and Senate Finance Committees on the implementation of this initiative, any programming or contractual changes made by the Department in response to its findings, and the impact of such changes on the program expenditures by October 1 of each year. Nothing in the report to the Governor and the Chairmen of the House Appropriations and Senate Finance Committees shall contain proprietary information."
