"E. Included in the amounts for this item is $447,760 the first year from the general fund for the costs associated with improvements required for a street or streets shown on a plat or plates recorded in the land records of the County of Washington, Virginia on or after January 1, 1999 and no later than December 31, 2007, to meet standards for acceptance into the secondary state highway system.  Such allocation shall be limited to streets that were identified on such plat to be constructed to meet such state standards, but for which the developer of such subdivision failed to construct such street in accordance with such plat representation, and for which the County holds insufficient surety to complete such construction.  Further, such funding shall be provided only if it is shown that the original developer neither exists as a current business entity registered in the business records of the State Corporation Commission nor owns any real property adjoining such streets, including ownership by an individual owner of such original developer business entity."
