t, except that the reduction shall be 1.329 percent for nursing facilities with 95 percent or greater Medicaid utilization in their provider fiscal year ending in calendar year 2008.  The Department of Medical Assistance Services shall amend the State Plan to authorize this change, and shall have the authority to implement this reimbursement change effective July 1, 2009, and prior to the completion of any regulatory process undertaken in order to effect such change."


Explanation
(This amendment reduces reimbursements to nursing facilities by three percent effective July 1, 2009, resulting in savings of $12.2 million GF and $12.2 million from federal Medicaid matching funds in FY 2010. However, nursing homes with Medicaid utilization greater than 95 percent are exempt, reducing the net savings to $12.0 million GF.)
