"4. a.  In apportioning the state and local share of the costs of providing an educational program meeting the Standards of Quality beginning July 1, 2009, each locality's ability to pay shall be based on the ratios of; (i) the reimbursement payment made to the locality for providing tangible personal property tax relief to the reimbursement payments made statewide for providing tangible personal property tax for state employees residing in that locality to the statewide value of real estate per person; (ii) the median value of residential real estate in the locality adjusted by the index used for the pay differential for state employees residing in that locality to the statewide median value of residential real estate; (iii) sales subject to the state sales tax in the locality to the statewide sales subject to the state sales tax; (iv) revenue collected from the personal property tax per person to the revenue collected statewide from the taxes.  These ratios shall be calculated on the basis of average daily membership and per capita.  To determine each locality's composite index of ability to pay; (i) the sum of the ratios calculated on the basis of average daily membership for each locality shall be divided by the sum of the average daily membership ratio for all localities; (ii) the sum of the ratios calculated on a per capita basis for each locality shall be divided by the sum of the per capita ratios for all localities; and; (iii) the locality's ratio calculated on the basis of average daily membership shall be multiplied by 0.66 and the locality's ratio calculated on a per capita shall be multiplied by 0.33.  The sum of the two adjusted ratios in clause (iii) shall be the local composite index of ability to pay."

Explanation
(This amendment proposes to significantly change the composite index funding formula that is used to distribute state funding for public education. Due to the complex nature of the proposed composite index funding formula change and the fact that some of the data sited in the prosed changes currently does not exist, the cost has been estimated at $100 million. This request is the companion budget amendment for the proposed legislation contained in House Bill 2198, which currently does not have a budget impact analysis. Once the budget impact has been completed for House Bill 2198, this budget amendment amount will be updated to reflect that cost.)
