"C.1. Included within this appropriation is $1,958,000 the first year and $4,146,000 the second year from the general fund to implement expanded monitoring of sex offenders using global positioning system (GPS) or other similar tracking devices as required by Chapters 853, 857 and 914 of the Acts of Assembly of 2006.
2. The Department is also authorized to use up to $690,830 the first year and $690,830 the second year from the general fund which is included in this item for sex offender containment programs to implement the provisions of Chapters 853, 857, and 914 of the Acts of Assembly of 2006.
3. For offenders under the Department's post-release supervision who are required to register with the Department of State Police sex offender registry, the Department of Corrections' probation and parole officers shall physically verify the sex offender registry registration information within the timeframes required. The Department shall coordinate these activities with the Superintendent of State Police to ensure all requirements of the legislation are met.
4. The Secretary of Public Safety, in conjunction with the Director of the Department of Corrections and Superintendent of State Police, shall report on the implementation of the monitoring of offenders. The report shall address at a minimum: (1) the number of sex offender registry verifications conducted; (2) the number of violations by type; (3) the status of coordination with other state and local law enforcement organizations' activities regarding the sex offender registry requirements; and (4) a review of Department staffing requirements to meet the provisions of the legislation. This report shall be provided to the Governor and the Chairmen of the House Appropriations and Senate Finance Committees by November 15, 2006."
Explanation
(This amendment provides an additional $1,958,000 the first year and $4,146,000 the second year from the general fund and 12 positions the first year and 24 positions the second year for supervision of convicted sex offenders, including procurement of global positioning system (GPS) or other similar tracking devices, as required by Chapters 853, 857 and 914 of the Acts of Assembly of 2006. This amendment also includes language authorizing the Department to utilize up to $690,830 each year in additional general funds included in HB 5002, the introduced budget, for sex offender monitoring and containment programs to meet the provisions of the legislation.)
