Explanation(This amendment establishes the Office of Sexually Violent Predator (SVP) Services within the Department of Mental Health, Mental Retardation and Substance Abuse Services pursuant to House Bill 1037. A companion amendment in Item 311 transfers existing funding of $325,000 each year for conditional release services to this office in this item. The creation of a separate funding stream and office are a recommendation of the Virginia State Crime Commission's Sex Offender Task Force. Funding in this item provides the following: (i) $506,250 from the general fund each year for clinical evaluations ($433,500) and court testimony ($72,750) for the for sexually violent predators who are being considered for release from state correctional facilities and who will be referred to the Clinical Review Committee for psycho-sexual evaluations prior to the state seeking civil commitment; (ii) $426,200 the first year and $610,200 the second year from the general fund for SVP conditional release services, including treatment; (iii) $39,600 the first year and $111,600 the second year for Global Positioning System monitoring of individuals on conditional release; and (iv) $219,958 the first year and $296,824 the second year for office staffing and operations.)
