Page 316, following line 57, insert:
"H. Included in this appropriation is $100,000 the first year from the general fund for planning a minimum-security, return-to-custody facility in Charlotte County.  The Department may contract with a private corporation previously selected for the construction or operation of such a facility, or may initiate a public-private partnership, pursuant to the Public-Private Education Facilities and Infrastructure Act of 2002 (Section 56-575.1 et seq. of the Code of Virginia), to finance the required facilities and related capital expenses.  Should the Department elect to contract with a previously-selected private corporation, no advertising, evaluation, or other work on the Department's previous competitive negotiation process for the procurement of a 1,000-bed minimum security prison to be located in Charlotte County need be redone, any provision of law to the contrary notwithstanding."


Explanation
(This amendment provides $100,000 the first year from the general fund for planning for a return-to-custody facility in Charlotte County. The department may consider the feasibility of contracting with a previously-selected private corporation for the construction and operation of such a facility, or initiating a public-private partnership, pursuant to the Public-Private Education Facilities and Infrastructure Act of 2002 (Section 56-575.1 et seq. of the Code of Virginia), to finance the facility.)
