Page 89, delete lines 3 through 9 and insert:
"A.1.  The amounts in this Item represent appropriations transferred to this agency from the Milk Commission.  The Commissioner of Agriculture and Consumer Services shall prepare and submit an operating plan for the combined agencies to the House Appropriations and Senate Finance Committees no later than July 1, 2003.  In developing the plan, the Commissioner shall consult with the Administrator of the Milk Commission and with representatives of the dairy industry.
2.  The seven-member Milk Commission shall continue within the Department of Agriculture and Consumer Services, and the Commission shall continue to exercise its responsibilities until such time as the General Assembly enacts legislation to alter or abolish the Commission."

Explanation
(This amendment deletes language directing the Department of Planning and Budget to submit an operating plan for the consolidation of the Milk Commission and the Department of Agriculture and Consumer Services. Instead, this responsibility is designated to the Commissioner of Agriculture and Consumer Services. The Administrator and the dairy industry will participate in the plan's development. In addition, the amendment continues the seven-member Milk Commission within the Department of Agriculture and Consumer Services.)
