Page 327, after line 3, insert:
"UUU.  Contingent upon an appropriation of the necessary funding and the approval by the Centers for Medicaid and Medicare Services for a Section 1115 waiver to establish a Medicaid Buy-In Waiver program to provide Medicaid coverage for up to 200 persons with disabilities with income in excess of traditional Medicaid levels but less than 175 percent of the Federal Poverty Level, the Department shall promulgate emergency regulations to become effective within 280 days or less from the enactment date of this act.  The Department shall seek authorization in the waiver for earned and unearned income requirements.   The waiver proposal shall be developed no later than October 1, 2003 and presented to the Governor and the Disability Commission by October 15, 2003."


Explanation
(This amendment requires the Department of Medical Assistance Services to seek a Medicaid waiver to establish a pilot program to allow people with disabilities whose income is less than 175 percent of the Federal Poverty Level to continue to receive Medicaid even though their income exceeds traditional Medicaid levels. The waiver proposal must be submitted to the Governor and the Disability Commission by October 15, 2003. Enrollment in the program would be limited to 200 individuals.)
