A. In addition to such other payments as may be available, the full cost of group health insurance, net of any deductions and credits, for the surviving spouses and dependents of certain public safety officers killed in the line of duty and for certain public safety officers disabled in the line of duty, and the spouses and dependents of such disabled officers, are payable from this Item pursuant to Title 9.1, Chapter 4, Code of Virginia. To the extent the appropriation in this Item is insufficient for these payments, the Director, Department of Planning and Budget, is authorized to transfer sufficient funding from Item 512 of this act.
B.1. The Department of Accounts and the Virginia Retirement System shall jointly conduct a study and develop recommendations in order to transfer the death benefit portion of the Line of Duty Act program from the Department of Accounts to the Virginia Retirement System's group life insurance program. The study findings and recommendations shall be reported to the Director of the Department of Planning and Budget by August 1, 2002, so that any legislation needed to implement this transfer may be drafted for the 2003 General Assembly Session.
2. The Department of Accounts and the Department of Human Resource Management shall jointly conduct a study and develop recommendations in order to transfer the health insurance benefit portion of the Line of Duty Act program from the Department of Accounts to the Department of Human Resource Management's health insurance program. The study findings and recommendations shall be reported to the Director of the Department of Planning and Budget by August 1, 2002, so that any legislation needed to implement this transfer may be drafted for the 2003 General Assembly Session.
C.1. Out of the amounts in this Item shall be provided $1,000,000 the first year and $2,150,000 the second year from the Criminal Injuries Compensation Fund at the Virginia Workers’ Compensation Commission for payment of death benefits and health insurance benefits under the Line of Duty Act. Of these amounts, up to $25,000 the first year and up to $50,000 the second year may be used by the Department for expenses associated with administration of the Line of Duty Act.
2. The Department is authorized to transfer cash from the Criminal Injuries Compensation Fund at the Virginia Workers’ Compensation Commission to this Item in order to provide for the payments and administrative expenses specified in the preceding subparagraph.
