"UUU.1. Out of this appropriation and from general funds appropriated in Item 326 of this act, $35,000,000 from the general fund and $35,100,000 from nongeneral funds the second year shall be provided to nursing facilities, inpatient hospitals, managed care health plans, pharmacists, and durable medical equipment providers to mitigate reimbursement reductions.
2. Of the total funds set forth in paragraph TTT.1., (i) $16,500,000 from the general fund and $16,700,000 from nongeneral funds shall be provided to nursing facilities for fiscal year 2004 direct and indirect care inflation adjustments, (ii) $10,900,000 from the general fund and $11,000,000 from nongeneral funds shall be provided to inpatient hospitals to correct reductions for rebasing reimbursement rates, (iii) $5,000,000 from the general fund and $5,000,000 from nongeneral funds shall be provided to restore a portion of the forecasted cost increase to manage care health plans in fiscal year 2004, (iv) $2,000,000 from the general fund and $2,000,000 from nongeneral funds shall be provided to restore one-half of the reduction to pharmacy dispensing fees, and (v) $150,000 from the general fund and $150,000 from nongeneral funds shall be provided to restore a portion of the payment reductions to durable medical equipment providers.  The Department of Medical Assistance Services shall have authority to enact emergency regulations under §2.2-4011 of the Administrative Process Act to effect this provision, if needed."


Explanation
(This amendment restores a portion of the total funds reduced in House Bill 1400, as introduced, to nursing facilities, inpatient hospitals, managed care health plans, pharmacies, and durable medical equipment providers by implementing the Protecting Access to Healthcare (PATH) program in this item and transfering the general fund appropriation for the Indigent Health Care Trust Fund for this purpose. Nursing facilities would receive full restoration of the inflation adjustment on direct and indirect care rates in fiscal year 2004. The restoration of funds to inpatient hospitals would correct reductions in House Bill 1400, related to the rebasing of hospital rates. Health plans would receive a portion of the funds reduced in House Bill 1400, as introduced. Pharmacies would have dispensing fees reduced from $4.25 to $3.75 per prescription instead of $3.25 per prescription proposed in the introduced budget. Durable medical equipment providers would also receive a portion of the funds reduced in House Bill 1400, as introduced. A companion amendment in Item 326 clarifies that once the general funds used to match hospital contributions for the Indigent Health Care Trust Fund are transferred, the payments to the Indigent Health Care Trust Fund by hospitals would be suspended.)
