Page 327, after line 3, insert:
"UUU.  The Department of Medical Assistance Services shall seek a Section 1115 waiver from the Centers for Medicare and Medicaid Services to establish a Medicaid Buy-In Program.  The Medicaid Buy-In Program shall provide Medicaid coverage for up to 200 disabled persons with income in excess of current Medicaid eligibility levels but less than 175 percent of the federal poverty level.   The Department shall seek authorization in the waiver for earned and unearned income requirements.  Contingent upon the receipt of approval of a Section 1115 waiver from the Centers for Medicare and Medicaid Services, the Department shall prepare a budget proposal for funding and develop emergency regulations to become effective within 280 days or fewer from the enactment date of this act and the appropriation of the necessary funding.  The waiver proposal and any necessary budget proposal shall be developed no later than October 1, 2004, and presented to the Governor and the Disability Commission by October 15, 2004."


Explanation
(This amendment requires the Department of Medical Assistance Services to seek a Medicaid waiver to establish a pilot program to allow people with disabilities whose income is less than 175 percent of the Federal Poverty Level to continue to receive Medicaid even though their income exceeds traditional Medicaid levels. The waiver proposal must be submitted to the Governor and the Disability Commission by October 15, 2004. Enrollment in the program would be limited to 200 individuals.)
