A. From the appropriation in this Item, $4,707,300 in the first year from the general fund is provided for the estimated increase in the operating costs of adult correctional facilities resulting from enactment, in the 2000 Session of the General Assembly, of legislation accomplishing the following purposes:
1. establishing a minimum, mandatory sentence for the second or subsequent conviction of distribution of controlled substances;
2. lowering the criteria for conviction as a “drug kingpin” and increasing the sentence for the offense;
3. establishing a minimum, mandatory sentence for distributing controlled substances on school grounds or near specified areas frequented by children;
4. establishing a minimum, mandatory sentence for transporting controlled substances in the Commonwealth;
5. establishing a minimum, mandatory sentence for distributing a handgun to a minor;
6. deleting the statutory age differential relating to distribution of controlled substances to persons under 18 years old;
7. enhancing the sentencing guidelines for persons previously convicted of possession of illegal drugs; and
8. strengthening the youthful offender program operated by the Department of Corrections.
B. The funds in this item shall be paid into the Corrections Special Reserve Fund, established in accordance with § 30-19.1:4 of the Code of Virginia.
