Explanation
(This amendment adds funding and 12 additional licensing positions within the Department of Social Services (DSS) to allow DSS, in consultation with the Department of Mental Health, Mental Retardation and Substance Abuse Services, to increase its oversight of services for mentally disabled residents living in adult care residences (ACRs). A 1997 JLARC study found that 47 percent of the public pay clients in ACRs had a behavioral health diagnosis. A 1999 Joint Commission on Health Care study found that 74 percent of the community services boards believed DSS’s enforcement of ACR regulations was inadequate to protect the health and safety of mentally disabled residents. The additional funding and positions will enable DSS to better protect the health and safety of the mentally disabled residents of ACRs. This is a recommendation of the Joint Commission on Health Care.)
