"X.  It is the intent of the General Assembly that the first-line use of the new atypical medications to treat seriously mentally ill Medicaid recipients should be supported by the formularies used to reimburse claims under the Medicaid fee-for-service and managed care plans.
Y.   The Department of Medical Assistance Services and the Department of Mental Health, Mental Retardation and Substance Abuse Services shall develop and implement a plan for retrospective review of Medicaid managed care plans of new, atypical medications used by Medicaid recipients to ensure appropriate access to the most effective atypical medications available to treat seriously mentally ill Medicaid recipients, except where indicated for the safety of the patient."


Explanation
(This amendment clarifies the intent of the General Assembly to support the use of the most effective medications to treat seriously mentally ill patients who are Medicaid recipients and to ensure adequate and appropriate coverage of these medications in Medicaid managed care plans. The availability of the new atypical medications is instrumental in preventing the hospitalization and readmission of individuals with serious mental illness and is supported by the federal Health Care Financing Administration and the National Institute of Mental Health. This is a recommendation of the Joint Subcommittee Studying the Future Delivery of Publicly Funded Mental Health, Mental Retardation and Substance Abuse Services.)
