"N.1.  The Department of Mental Health, Mental Retardation and Substance Abuse Services and the Department of Medical Assistance Services shall submit a plan for implementing an alternative structure for administering policy and funding for community mental health rehabilitation services; targeted mental health and mental retardation case management; substance abuse treatment for pregnant and postpartum women; intensive in-home and therapeutic day treatment for child and adolescent services in the Early and Periodic Screening, Diagnosis and Treatment Program; mental retardation home and community-based waiver services; and any other new or expanded mental health, mental retardation and substance abuse services, related to the above-listed services, that are covered subsequently by the Medicaid program.  The structure shall be based on the model developed and recommended by the Joint Subcommittee Studying the Future Delivery of Publicly Funded Mental Health, Mental Retardation and Substance Abuse Services.  It shall include the provision of a subcontract for the administration of the above-listed services between the Department of Mental Health, Mental Retardation and Substance Abuse Services, and the Department of Medical Assistance Services that may include provider certification, service authorization, utilization review, and data collection and analysis. The subcontract shall also specify the Department of Mental Health, Mental Retardation and Substance Abuse Services' responsibility for participating in policy and regulatory development for the above-listed services, as described in the Joint Subcommittee's recommendations, subject to the Department of Medical Assistance Services' oversight and approval with respect to compliance with federal law.  The Department of Medical Assistance Services shall be responsible for paying claims for the above-listed Medicaid-covered services on a fee-for-service basis.
2.  The plan shall include provisions for (i) transferring all state general fund match that currently is appropriated to the Department of Mental Health, Mental Retardation and Substance Abuse Services for the above-listed Medicaid-covered services to the Department of Medical Assistance Services for payment of these service claims in (ii) analyzing Medicaid fee collection trends by community service boards and behavioral health authorities during the last half of fiscal year 2000 and adjusting state general fund allocations so that post year-end adjustments for state matching general funds are minimized; (iii) making a final adjustment for fiscal year 2000 state matching general funds for Medicaid federal funds after the end of fiscal year 2000 to minimize any potential reduction of state funds for community service boards or behavioral health authorities that did not collect Medicaid revenues as anticipated in their general fund match allocations; and (iv) appropriating future matching general funds for the above-listed services to the Department of Medical Assistance Services for claims reimbursement.
3.  Community service boards and behavioral health authorities shall continue to be the single point of entry into the services system for community mental health rehabilitation services; targeted mental health and mental retardation case management; substance abuse treatment for pregnant and postpartum women; intensive in-home and therapeutic day treatment for child and adolescent services in the Early and Periodic Screening, Diagnosis and Treatment Program; mental retardation home and community based waiver services; and any other new or expanded mental health, mental retardation and substance abuse services related to these services that are covered subsequently by the Medicaid program.  These organizations shall also function as care coordinators, following specific practice guidelines to be developed cooperatively with the Department of Mental Health, Mental Retardation and Substance Abuse Services.  They shall also be responsible for development of a service network, with responsibility for identifying, supporting, and assisting the establishment of new service providers.
4.  The Department of Mental Health, Mental Retardation and Substance Abuse Services and the Department of Medical Assistance Services shall complete their plan and report to the Chairmen of the House Appropriations and Senate Finance Committees by April 28, 2000."


Explanation
(This amendment directs the Department of Mental Health, Mental Retardation and Substance Abuse Services (DMHMRSAS) and the Department of Medical Assistance Services (DMAS) to develop a plan to implement recommendations of the Joint Subcommittee Studying the Future Delivery of Publicly Funded Mental Health, Mental Retardation and Substance Abuse Services related to the structure and funding of mental health, mental retardation and substance abuse services. It creates a partial "carve-out" of Medicaid-reimbursed services that would be administered through DMHMRSAS. It would not change existing arrangements for Medicaid funding of state mental health and mental retardation facilities, or those medical/surgical inpatient psychiatric, outpatient clinic, and pharmacy services administered by the Department of Medical Assistance Services and provided through its managed care plans. However, the plan would provide for future appropriations for matching general funds for the "carved out" services to be made to DMAS. DMAS would incorporate these services into its expenditure forecasting process. In anticipation of moving the general fund match for the certain Medicaid-reimbursed services from DMHMRSAS to DMAS, language is added to require DMHMRSAS to analyze its allocations to community service boards and behavioral health authorities of matching general funds for the collection of federal Medicaid matching funds to ensure potential reductions in general funds are minimized to those boards and authorities that did not collect Medicaid revenues at the level anticipated by their original general fund allocations. Reimbursement for mental health, mental retardation and substance abuse services described in paragraph N.1. above would be made by DMAS on a fee-for-service basis. This is a recommendation of the Joint Subcommittee Studying the Future Delivery of Publicly Funded Mental Health, Mental Retardation and Substance Abuse Services.)
