Authority: §§ 16.1-278.8, 16.1-285.1, 66-13, 66-18, 66-19 and 66-22, Code of Virginia.

A. The Department of Juvenile Justice shall retain all funds paid for the support of children committed to the department to be used for the security, care and treatment of said children.

B. Out of the amounts for secure confinement $645,154 the first year and $2,128,408 the second year from nongeneral funds are provided for the operations of the Culpeper Detention Facility and the Culpeper Juvenile Correctional Center. The source of these funds shall be fees paid by localities to the Department for housing juveniles in the detention facility. Fees collected in excess of the appropriation shall be deposited to the general fund. The Department is authorized to obtain a treasury loan to cover any costs incurred before sufficient revenues are received to cover these costs.

C. The Department of Juvenile Justice shall develop a plan to transfer residents from Hanover Juvenile Correctional Center to the Culpeper Juvenile Correctional Center, in order to make older facilities at the Hanover facility available for renovation. The Department shall also consider the feasibility of using federal funds available under the Juvenile Accountability Incentive Block Grant for these renovations and shall propose a capital outlay project for this purpose to the Department of Planning and Budget.

D. The Department of Juvenile Justice shall provide a progress report to the General Assembly on the LEADER program. This report shall include information on the status of the program in each of the facilities in which the program has been implemented, a description of the services provided, the number of juveniles who have participated in the program, documentation of their adjustment to the requirements of the program and the rate of completion of the program, and demographic and criminal records data on the juveniles in the program. Interim reports shall be presented to the 1999 and 2000 Sessions of the General Assembly, with a final report to the 2001 Session. The final report shall also include an assessment of the impact of the LEADER program in reducing recidivism.

E.1. Included in this appropriation is $1,582,053 the second year from the general fund to provide salary increases to juvenile corrections officers and juvenile corrections officer supervisors, effective November 25, 1999. The increases, which are in addition to any other compensation supplements provided in this act, shall be provided on the basis of a plan developed by the Department of Juvenile Justice in conjunction with the Department of Personnel and Training and approved by the Secretary of Public Safety.

2. The plan, at minimum, shall provide for pay step increases for all position classifications and the establishment of a career development program for juvenile corrections officers. To accomplish the latter goal, the plan shall provide for the establishment of two additional classifications within the correctional officer classification series – Juvenile Corrections Officer First Class and Juvenile Corrections Master Officer. The plan shall include the standards for movement into the Juvenile Corrections Officer First Class and Juvenile Corrections Master Officer classifications. Such standards shall include, but are not limited to, job related knowledge, skills and abilities, physical conditioning and agility, educational attainment, and disciplinary record. To the extent feasible, objective forms of measurement shall be used to identify those persons qualified for movement to Juvenile Corrections Officer First Class and Juvenile Corrections Master Officer classifications.

3. The approved plan shall be submitted to the Governor and the chairmen of the House Appropriations and Senate Finance Committees by November 1, 1999.
