"M.  Out of this appropriation, $1,417,590 the second year from the general fund shall be provided for placement and restoration services for juveniles found to be incompetent to stand trial pursuant to Article 18 of Chapter 167 of the Code of Virginia.  The Commissioner shall develop requests for proposals to solicit public or private providers to deliver such services.  Funding may be awarded on a statewide or regional basis providing the applicant is able to demonstrate the ability to provide restoration services within 100 miles of the juvenile's home.  To qualify for a response to the request for proposals, the applicant(s) must, at a minimum:  (i) address the their ability to provide restoration services in the juvenile's home; (ii) provide placement and restoration services in group home and secure settings as defined by §16.1-228 of the Code of Virginia; (iii) provide assessment of the juvenile's competency for consideration of the Juvenile and Domestic Relations Court ordering the restoration services; and (iv) have the capacity to transport the juveniles as needed.  The requests for proposals must be disseminated to the field for response by August 1, 1999, and funds shall be awarded by October 1, 1999."


Explanation
(This amendment provides $1,417,590 for restoration services for juveniles found incompetent to stand trial pursuant to Article 18, Chapter 16 of the Code of Virginia through statewide or regional contracts, pursuant to Senate Bill 1039. Based on anticipated utilization, it is intended that the following percentages of the total contract amount be available to each of the Department's regions of the state: Region I, three percent; Region II, 15 percent; Region III, 20 percent; Region IV, 31 percent; and Region V, 31 percent. Of the total funding, $112,280 shall be used for hiring two positions in the Forensic Unit of the Department to oversee the contracts and coordination of services between the providers awarded the contracts and Juvenile and Domestic Relations Court.)
