Authority: Title 5.1, Chapter 1; Title 10.1, Chapter 11.1; and Title 62.1, Chapters 2, 3.1, 3.2, 3.6, 5, 6, 20, 22, 24, and 25, Code of Virginia.


A. The Department of Environmental Quality is authorized to commit resources necessary to qualify for in-kind match for the U.S. Army Corps of Engineers for the John H. Kerr Dam and Reservoir, Virginia and North Carolina Feasibility Study, to be conducted in accordance with § 216 of the River and Harbors Flood Control Act of 1970.


B. Notwithstanding the provisions of Title 10.1, Chapter 25, Code of Virginia, the Department is authorized to expend up to $226,476 the first year and $90,000 the second year from the balances in the Virginia Environmental Emergency Response Fund to enhance water quality monitoring in the Elizabeth and Shenandoah Rivers.


C. Out of the amounts for this Item shall be provided $170,000 the first year from the general fund to investigate the potential factors resulting in fish lesions and mortality in the Shenandoah River.


D. The appropriation includes annual membership dues for the Interstate Commission on the Potomac River Basin, $150,000 the first year and $150,000 the second year, from the general fund.


E. The appropriation includes annual membership dues for the Ohio River Valley Water Sanitation Commission, $44,900 the first year and $44,900 the second year, from the general fund.


F. Out of the amounts for this Item shall be paid $50,000 the first year and $50,000 the second year from the general fund to the Chesapeake Bay Foundation to support Chesapeake Bay education field studies.
