New Construction: Central Chilled Water Plant (16101)
B.1. The General Assembly authorizes Virginia Commonwealth University, with approval of the Governor, to construct a central chilled water plant and distribution system on, or in close proximity to, the University's MCV Campus. This project must be consistent with the guidelines of the Department of General Services and comply with the Alternative Construction and Financing Guidelines issued by the Secretary of Finance on July 1, 1992.
2. The General Assembly authorizes Virginia Commonwealth University to enter into a written agreement with a public or private entity: 1) to design, construct, finance and operate a central chilled water facility to serve the University's MCV Campus and 2) to recover costs from operational savings attributable to such project. The facility may be located on property owned by the Commonwealth. All project proposals and approvals shall be in accordance with the guidelines cited in paragraph 1 of this Item.
New Construction: Student Residence Hall (16093), and
New Construction: Gladding Residence Hall Addition (16338)
C.1. The General Assembly authorizes Virginia Commonwealth University, with approval of the Governor, to explore and evaluate an alternative financing scenario to provide the additional student housing. This project must be consistent with the guidelines of the Department of General Services and comply with the Alternative Construction and Financing Guidelines issued by the Secretary of Finance on July 1, 1992 Treasury Board Guidelines issued pursuant to § 23-19 (d) (4), Code of Virginia, and any subsequent amendments thereto.
2. The General Assembly authorizes Virginia Commonwealth University to enter into written agreement with a public or private entity to design, construct, and finance a facility to provide additional student housing. The facility or facilities may be located on property owned by the Commonwealth. All project proposals and approvals shall be in accordance with the guidelines cited in paragraph 1 of this Item.
3. If the University chooses not to utilize its 9(C) revenue bond authorizations as provided in Item C-8 of this act, the University may pursue financing for this project pursuant to Article X, Section 9 (d) of the Constitution of Virginia as provided in this Item.
4. The General Assembly further authorizes Virginia Commonwealth University to enter into a written agreement with its affiliated real estate foundation to construct one or more facilities on university land to provide additional student housing, to be leased to that foundation for such purposes. Virginia Commonwealth University is also authorized to enter into a written agreement with that foundation for the support of such student housing facilities by including the student housing facilities in the university's student housing inventory and managing the operation and maintenance of the facility, by assigning students to the facility in preference to other university facilities, by restricting construction of competing student housing projects, and by otherwise supporting those student housing facilities consistent with law, provided that the university shall not be required to take any action that would constitute a breach of the university's obligations under any documents or other instruments constituting or securing bonds or other indebtedness of the university or the Commonwealth of Virginia.
D. The General Assembly authorizes Old Dominion University to construct a parking deck on lot 30 provided the University does not increase its comprehensive student fees to cover the project's debt service. Prior to the issuance of bonds, the University must certify, in writing to the Departments of Planning and Budget and Treasury, that the University's comprehensive fee will not increase to support the debt service.

F. Notwithstanding the provisions of § 11-41 C 2 (ii), Code of Virginia, the University of Virginia is authorized to engage in competitive negotiation for the construction of the Scott Stadium Expansion Project.
Biomedical Engineering and Medical Sciences (15924)
G. The Board of Visitors of the University of Virginia is authorized to utilize competitive negotiation, as that term is defined in § 11-37, Code of Virginia, to secure construction services for the Biomedical Engineering and Medical Sciences project, the provisions of § 11-41, Code of Virginia, notwithstanding.
