"E. 1. Out of this appropriation, $87,000,000 the first year and $87,000,000 the second year from the general fund is designated to cover the cost of tuition and fee waivers granted under the Virginia Military and Survivors and Dependents Education Program (VMSDEP) pursuant to

§ 23.1- 608, Code of Virginia and this Item.


2. a. Each public institution of higher education shall report the number of students receiving waivers and the total cost of waivers in the prior fiscal year to the State Council of Higher Education for Virginia by September 1 each year.


b. Upon certification of the numbers reported by The State Council of Higher Education for Virginia, and no later than October 15 each year, the Director, Department of Planning and Budget shall transfer funds to each public institution of higher education in an amount equal to the cost of waivers granted at that institution in the prior fiscal year.


c. If the total cost of waivers granted in the prior fiscal year exceeds the funding identified in paragraph E.1, each institution shall receive a prorated amount of the total funding identified, and the Governor shall include in his next introduced budget bill recommended appropriations to ensure the funding identified is sufficient to cover the total cost of waivers."

(This amendment provides $87.0 million GF each year to cover the cost of tuition and fee waivers granted under the Virginia Military and Survivors and Dependents Education Program (VMSDEP) pursuant to § 23.1- 608, Code of Virginia and this Item.)
