Page 488, after line 43, insert:

"E. The Commissioner of Highways (Commissioner) shall evaluate whether roadways operating under the Virginia Highway Corporation Act of 1988 (HCA) would serve the public interest if operated under the Public-Private Transportation Act of 1995 (PPTA).  If the Commissioner determines that a roadway operating under the HCA would serve the public interest by operating under the PPTA, the Commissioner shall negotiate the key business terms of a new comprehensive agreement for operation under the PPTA and, following local public outreach, present them to the Transportation Public-Private Steering Committee. The key business terms shall provide toll rate reductions and distance-based tolling and shall not include any Commonwealth contribution or assumption of debt by the Commonwealth.  If the Commissioner, Secretary of Transportation, and the Transportation Public-Private Steering Committee each concur that it is in the public interest for a roadway operating under the HCA to operate under the PPTA in accordance with the negotiated key business terms, the Commissioner is authorized to finalize and execute a new comprehensive agreement between the roadway operator and the Department of Transportation to authorize the projects operation under the PPTA.”

(This is a language-only amendment that authorizes the Commissioner to evaluate whether the contract for the Dulles Greenway should be converted to a PPTA contract.)
