"WWWW. 1. The Department of Medical Assistance Services shall seek authority through the State Plan to implement a neurobehavioral science unit to support individuals with traumatic brain injuries and neurocognitive disorders by January 1, 2025. The neurobehavioral science unit shall be considered as one of the alternative institutional placements for individuals needing TBI waiver services. The department shall set service definitions, administrative structure, eligibility criteria and reimbursement rates in administration of the program.

2. The department shall submit an amendment to its existing 1915c waiver or seek a new 1915c waiver as appropriate to receive federal approval to administer neuro-restorative and rehabilitative services for qualifying individuals with traumatic brain injury and neurocognitive diagnoses no later than January 1, 2026. The department shall set service definitions, administrative structure, eligibility criteria, and reimbursement rates in administration of the program.  

3. The department shall have authority to promulgate emergency regulations for the neurobehavioral science unit and the TBI waiver.

4. The department shall convene an advisory workgroup with relevant stakeholders to provide updates on the progress of implementation of the neurobehavioral unit and the TBI Waiver."



Explanation

(This amendment provides $26.6 million from the general fund and $47.4 million from nongeneral funds each year for the Department of Medical Assistance Services to amend the State Plan for Medical Assistance to add neurobehavioral services to support Medicaid enrollees with traumatic brain injuries and neurocognitive disorders beginning January 1, 2025.)
