"WWWW.1.  The Department of Medical Assistance Services shall amend the State Plan for medical assistance services to add neurobehavioral and neurorehabilitation facilities to support individuals with traumatic brain injuries and neurocognitive disorders by January 1, 2025. The neurobehavioral and neurorehabilitation facilities shall be considered as an alternative institutional placement for individuals requiring traumatic brain injury 1915(c) home and community-based waiver services. The department shall set service definitions, administrative structure, eligibility criteria, eligibility and enrollment processes, and reimbursement rates required for administration of the program.

2.  The department shall seek appropriate federal approval from the Centers for Medicare and Medicaid Services to administer home and community-based services for qualifying individuals with traumatic brain injuries or neurocognitive disorders as defined by the department no later than January 1, 2026. The department shall set service definitions, administrative structure, eligibility criteria, eligibility and enrollment processes, and reimbursement rates required for administration of the program.

3. The department shall have authority to promulgate emergency regulations for the neurobehavioral and neurorehabilitation facilities and the traumatic brain injury waiver upon approval.

4. The department shall have the authority to enhance data sharing and operational supports with the Department of Aging and Disability Services to more effectively coordinate the provision of Brain Injury Services.

5. The department shall convene a work group of relevant stakeholders to provide updates on the progress and the implementation of the neurobehavioral and neurorehabilitation facilities and the traumatic brain injury services waiver."



Explanation

(This amendment provides funds each year to fund facility-based services and a waiver program for individuals with brain injury. Funding is allocated to cover facility services for 575 individuals experiencing traumatic brain injuries and neurocognitive disorders in the Commonwealth. Language authorizes the Department of Medical Assistance Services to amend the State Plan and secure federal approval.)
