"L.1. Out of this appropriation, $13,476,297 the first year and $13,476,297 the second year from the general fund is provided for claims taking, adjudication, benefit payment control, appeals, data analysis, and administrative costs for reporting on Virginia's performance vis-a-vis, and ensuring compliance with, federal core unemployment insurance performance measures. As a condition of this appropriation, VEC shall maintain the following minimum critical position levels: 40 Appeals Staff, 80 Adjudication Staff, and 120 Contact Center Support Staff.

2.The commission shall provide quarterly reports to the General Assembly detailing the state's performance in each of the Department of Labor's Unemployment Insurance (UI) Core Measures, which are used to assess conformity with the Social Security Act. The commission shall make this report conspicuously available on its website. The report shall include the following information for each core measure: (1) Virginia's current quarterly performance; (2) Virginia's quarterly performance for each of the prior three quarters; (3) Virginia's rank amongst all jurisdictions for the current quarterly performance; (4) Virginia's rank amongst all jurisdictions for each of the prior three quarters; and, (5) the federal performance standard.

3. Where Virginia's performance falls short of the acceptable federal performance standard, the commission shall provide a detailed explanation of the state's unsatisfactory performance and set forth a detailed plan and timeline for bringing the state to conformity with the federal standard. The commission shall also provide an explanation for any drops in performance or ranking in the most recent quarter.

4. Where Virginia's performance in First Payment Timeliness and Nonmonetary Determination Timeliness fails to conform to federal standards, the commission shall, in plain language, provide conspicuous notice of the agency's performance in each measure on its website, and in relevant written notices including Statement of Wages and Potential Benefit and Decisions of Deputy.

5. Where Virginia's performance in Average Age of Pending Lower Authority Appeals fails to conform to federal performance standards, the commission shall, in plain language provide conspicuous notice of the Average Age of Appeal on its website, including where online appeals are filed, in written appeals forms, and in other relevant notices including, but not limited to Decisions of Deputy and to Notices of Appeal issued as a result of appeals to such Decisions of Deputy.

6. The commission shall report annually to the Commission on Unemployment Compensation on the following: Adequacy of the current taxable wage base to maintain sufficient trust fund solvency;  adequacy of current experience rating measures to maintain sufficient trust fund solvency; feasibility of maintaining an administrative fee to support critical staffing and technology requirements while maintaining sufficient trust fund solvency; and sufficiency of current weekly benefit amounts to provide intended stabilizing effect on unemployed workers and the Commonwealth's economy."

(This amendment provides $13.5 million in each year for additional staff at the Virginia Employment Commission to provide detailed reporting information and related notices on the federal core measures for the unemployment insurance program and the solvency status of the UI Trust Fund.)
