"WWWW. Effective July 1, 2024, the Department of Medical Assistance Services shall submit amendments to the federal Centers for Medicare and Medicaid for the Community Living, the Family and Individual Support and the Building Independence Developmental Disability Waivers to add, in the limited circumstances set forth herein, an option for supporting participants in an acute care hospital when necessary supports (including communication and intensive personal care) are outlined in the individual's service plan and are not available in that setting, or when the individual requires support for communication and behavioral stabilization, and such support is not otherwise provided in that setting. Services would be available for those individuals, 18 years of age or older, who are admitted to an acute care hospital while receiving any one of the following services: (i) group home residential, (ii) sponsored residential, (iii) supported living/in-home, (iv) independent living, (v) shared living, or (vi) personal care (agency directed or consumer directed). The department shall have the authority to implement these changes prior to completion of any regulatory process undertaken in order to effect such change."



Explanation

(This amendment provides $1.3 million from the general fund and $1.3 million from the nongeneral fund each year to direct the Department of Medical Assistance Services to submit amendments to the federal Centers for Medicare and Medicaid for the Developmental Disability Waivers to provide Medicaid payment for designated staff support for adults with developmental disability in acute care settings. Language sets forth requirements for these payments and provides the agency with emergency regulation authority to implement the changes.)
