"P. Notwithstanding the definition of isolated confinement provided in Senate Bill 887, isolated confinement means confinement of an incarcerated person to a cell for 20 hours or more per day, regardless of the name of the housing unit in which such confinement occurs. Included in the appropriation for this item is $2,600,000 the second year from the general fund for the Department to implement the remaining provisions of Senate Bill 887, which prohibits isolated confinement except under certain conditions. The Department shall provide quarterly reports to the General Assembly that provide the number of inmates who spend 17 or more hours per day confined in their cell and the number of inmates who spend 20 or more hours per day in their cell, regardless of housing unit and to include individuals in special purpose beds including secure beds, step down beds, and other special purpose beds for individuals receiving mental health treatment. The Department shall also provide a report to the General Assembly by November 15, 2023, assessing the costs and feasibility of Senate Bill 887. The funding shall be used to hire casework counselors and mental health professionals with the same level of certification as professionals who perform Institutional Classification Authority hearings."



Explanation

(This amendment provides $2.6 million GF the second year to support implementation of provisions of Senate Bill 887, which prohibits isolated confinement except under certain conditions. Language defines isolated confinement as 20 hours or more per day in a cell and directs the Department to report to the General Assembly by November 15, 2023, on the costs and feasibility of implementing SB 887. Language also directs the Department to provide quarterly reports to the General Assembly on the number of inmates confined to their cell for more than 17 hours per day.)
