"GG.1. The Department of Medical Assistance Services (DMAS) is authorized to begin the reprocurement of the Commonwealth's managed care service delivery system with an implementation date no earlier than July 1, 2025. DMAS shall consider stakeholder feedback as part of the agency's process in developing changes to the managed care program to enhance health care delivery and improve cost effectiveness of the system.  DMAS shall convene at least two public meetings to receive public comment from stakeholders and shall take such feedback into account as part of the process in making changes to the system and in developing the Request for Proposals (RFP). The RFP shall be submitted to the Joint Subcommittee for Health and Human Resources Oversight and the Department of Planning and Budget by October 15, 2023. The joint subcommittee shall review the RFP and convene a meeting by December 31, 2023, to receive public comments on the RFP.  DMAS shall not release the RFP unless specifically authorized by the General Assembly in the 2024 Session.

2. DMAS shall in development of the RFP incorporate provisions: (i) to standardize claims and service authorization processes; (ii) require one fiscal agent for consumer-directed services; (iii) require development of more robust provider networks, especially for behavioral health; (iv) encourage more innovation in value-based payment; and (v) consider the financial risks to the Commonwealth and incorporate profit caps, medical loss ratios, and risk corridors accordingly.  The reprocurement of the managed care contacts shall not include the following services, which shall remain in fee-for-service: (i) dental services; (ii) developmental disability waiver services; (iii)  and other services currently excluded from the managed care contracts.  DMAS shall no include any new services in the RFP unless explicitly authorized by the General Assembly.

3. DMAS shall ensure that the cost of any programmatic and/or contractual changes are fully accounted for in the Appropriation Act. Contract and program changes associated with this reprocurement shall not create any future funding commitments unless authorized by the General Assembly.

4. Out of this appropriation, $500,000 from the general fund the second year shall be used by the Joint Legislative Audit and Review Commission, in collaboration with the Joint Commission on Health Care, to contract with a vendor to review the RFP and to report on all program changes in the RFP as compared to the existing contracts, an estimate of any fiscal impact of such changes, and also to review that the RFP is consistent with best practices in Medicaid managed care contracting. The Department of Planning and Budget shall transfer the necessary appropriation, up to $500,000 from the general fund to JLARC, upon notice of a contract award."



Explanation

(This amendment provides direction to the Department of Medical Assistance Services in regards to the reprocurement of the Medicaid managed care contracts. In addition, $500,000 the second year from the general fund is provided for an independent review of the proposed changes in the program and any fiscal impacts. In addition, since the implementation of the new contracts is delayed, the administrative funding provided in the introduced budget is unnecessary and removed with this amendment.)
