Page 112, after line 24, insert:

"N.1. Notwithstanding the provisions of Chapter 1, 2022 Special Session I, Item 479.20, paragraph B.2.b.3) and Item 486, paragraph A.2.b.2) of this act, the $16,000,000 provided for the Line Extension Customer Assistance Program (LECAP) from the federal State and Local Recovery Fund of the American Rescue Plan Act shall be allocated as follows: $8,000,000 for construction grants to extend existing broadband networks to residential buildings where residents have low to moderate income and $8,000,000 for construction grants to extend existing broadband networks to residential buildings without regard to a resident's income. The department shall establish program guidelines to effectuate the provisions of this paragraph, and allow for applicants to attest that their income places them within the low-to-moderate income limits established by the department. If the funds appropriated in this paragraph remain unspent for its dedicated purpose by December 31, 2025, then the department may allocate any remaining funds between the purposes established above.

2. The department shall direct, at a minimum, $16,000,000 of funds received by Virginia from the Federal Infrastructure and Jobs Act (Public Law 117-58) for broadband access to the LECAP program.

3. Any federal funds designated for this program, including the amounts in the paragraph above, shall be allocated evenly between a focus on low-to-moderate income households and all households irrespective of income, unless otherwise restricted by federal law."

Explanation

(This amendment updates language for the Line Extension Customer Assistance Program, funded with federal funds from the American Rescue Plan Act. It allocates $16.0 million of federal funds provided for this program between serving low-to-moderate income households and all households that may need assistance to extend existing broadband networks to their homes. Additionally, it directs $16.0 million of anticipated funding for broadband connectivity from the Federal Infrastructure and Jobs Act to this program. At a minimum, Virginia is expected to receive at least $100.0 million in broadband funding from this act.)
