Page 95, line 17, before "The" insert "A. "

Page 95, after line 19, insert:

"B. If an applicant for a new or renewed commercial applicators or registered technician certification pursuant to § 3.2-3930, Code of Virginia, has not received a Letter of Approval or Denial from the Department within 10 days of the Commonwealth processing the payment for the application, either via mail or electronic means, the applicant shall be deemed approved to take the examination by the Commissioner. Upon passage of the examination by the applicant, the individual shall be granted a certificate by the Commissioner unless the Department verifies the individual has not completed the training requirements as outlined in § 3.2-3930, Code of Virginia. The Department of Motor Vehicles shall use whichever means they deem most appropriate to verify the identity and application status of said applicants."



Explanation

(This amendment extends automatic approval for examination for commercial pesticide applicators or registered technicians if they have never been notified of approval or denial by the Department of Agriculture and Consumer Services within 10 days of the Department receiving the application. Such approval would remain in place until the Department verifies the qualifications of the applicant pursuant to § 3.2-3930, Code of Virginia.)
