Page 542, after line 5, insert:

"F. The Commissioner of Highways (Commissioner) shall evaluate whether roadways operating under the Virginia Highway Corporation Act of 1988 (HCA) would serve the public interest if operated under the Public-Private Transportation Act of 1995 (PPTA).  If the Commissioner determines that a roadway operating under the HCA would serve the public interest by operating under the PPTA, the Commissioner shall negotiate the key business terms of a new comprehensive agreement for operation under the PPTA and present them to the Transportation Public-Private Steering Committee. The key business terms shall provide toll rate reductions and distance-based tolling and shall not include any Commonwealth contribution or assumption of debt by the Commonwealth.  If the Commissioner, Secretary of Transportation, and the Transportation Public-Private Steering Committee each concur that it is in the public interest for a roadway operating under the HCA to operate under the PPTA in accordance with the negotiated key business terms, the Commissioner is authorized to finalize and execute a new comprehensive agreement between the roadway operator and the Department of Transportation to authorize the projects operation under the PPTA."

(This amendment authorizes the Commissioner to evaluate whether the contract for the Dulles Greenway should be converted to a PPTA contract.)
