Page 71, line 9, strike: "not to exceed $100,".
Page 71, line 14, strike "$100" and insert:  "the maximum fee that may be imposed by the department."
Page 71, line 15, after "and Forestry." insert:
"Provided however, that beginning July 1, 2011, the fee structure shall not be a flat rate for all entities subject to inspection but shall be set on a graduated scale based on annual sales of the establishments to be inspected.  It is the intent of the General Assembly that revised fee schedule be revenue neutral and result in neither loss of revenue to the department or the generation of additional nongeneral revenues beyond the amounts collected in fiscal year 2011."

Explanation
(This amendment requires the Virginia Department of Agriculture and Consumer Services to adjust the annual food licensing fee in a revenue neutral manner to set the fees on a graduated scale based on annual sales of the establishments to be inspected.)
