Page 398, after line 7, insert:
"C. The Virginia Port Authority is hereby directed to enter into an agreement with the City of Suffolk no later than August 31, 2011 regarding appropriate levels of funding the Authority shall transfer to the City of Suffolk to assist in the financing of two grade separation projects required to begin to address the traffic congestion caused by the expanded traffic associated with freight traffic resulting from the APM Terminal in the City of Portsmouth.  It is the intent of the General Assembly that the agreement required provide for the Authority to fund at least ninety percent of the project design, right of way and construction costs and that such project funding shall be provided to the City no more than ninety days following completion of final design and right of way acquisition.  Such agreement may further require the Authority to provide up to ninety percent of the design and right of way elements of the project as such costs are incurred by the City of Suffolk."


Explanation
(This amendment directs the Virginia Port Authority to enter into a cost-share agreement with the City of Suffolk to undertake grade-separation projects required to address the increased traffic and congestion, associated with the expansion of freight traffic at the APM Terminal which travels through the City of Suffolk resulting in roadway degradation.)
