Page 310, after line 15, insert:
"3.  Out of the amounts for this appropriation, the Department of Environmental Quality shall use an amount not to exceed $3,000,000 from the Water Quality Improvement Fund to conduct the James River chlorophyll study pursuant to the approved Virginia Chesapeake Bay TMDL Phase I Watershed Implementation Plan.  This amount shall be used solely for contractual support for (a) water quality monitoring and analysis in an amount not to exceed $1,000,000 and (b) computer modeling in an amount not to exceed $2,000,000.  No portion of this funding may be used for administrative costs of the department."


Explanation
(This amendment requires the Department of Environmental Quality to spend up to $3.0 million of the total $3.6 million share of the Water Quality Improvement Fund deposit allocated to point sources for the performance of a study of the chlorophyll standard imposed for the James River by the U.S. Environmental Protection Agency (EPA). The U.S. EPA's chlorophyll standard increased the level of nutrient reductions that must be achieved along the James River. Virginia's Watershed Implementation Plan caveats its response to additional measures to reduce nutrient pollution in the James River by a need to further study this chlorophyll standard. Public wastewater treatment plants along the river could be required to achieve additional nutrient reductions as a result of the U.S. EPA's imposition of this chlorophyll standard.)
