E-911 Tax Line of Duty Fee Surcharge

"Notwithstanding the provisions of §9.1-400-405, §56-484.12, and §58.1-1730, Code of Virginia, there is hereby assessed a $0.50 surcharge imposed on the end user of each access line for which the $0.75 E-911 fee is currently charged, as defined by §56-484.12 and §58.1-1730.  Benefits paid under the Line of Duty Act shall be funded by the first $0.18 of the surcharge, which shall be billed, collected and remitted in the same manner as the E-911 fee and shall be deposited by the Virginia Information Technologies Agency and the Department of Taxation, as applicable, directly to the Line of Duty Death and Health Benefits Trust Fund of the state treasury and on the books of the State Comptroller.  The remaining $0.32 of the surcharge shall be billed, collected and remitted in the same manner as the E-911 fee and shall be distributed by the Virginia Information Technologies Agency to local governments operating public safety answering points in the same manner as 60 percent of the E-911 Wireless Fund as provided for in §56-484.17(c). "


Explanation
(This amendment establishes an additional $0.50 monthly surcharge on cellular telephones with $0.18 dedicated to fund Line of Duty Act benefits. The remaining $0.32 would be distributed to local Public Safety Answering Points (PSAPs) using the current allocation process.)
