A. Out of this appropriation, $12,500 the first year and $12,500 the second year from the general fund shall be provided for the activities of the Sewage Appeals Review Board.
B.1. Notwithstanding § 32.1-246, Code of Virginia, effective July 1, 2010, the Commissioner of Health shall assess and collect a fee of no more than $700.00 for an application for sanitary facilities, plan review, and initial certificate for a marina.
2. Notwithstanding § 32.1-246, Code of Virginia, effective July 1, 2010, the Commissioner of Health shall assess and collect a fee of no more than $525.00 to be charged once every five years, for a Certificate to Operate permit renewal.
3. Notwithstanding § 32.1-246, Code of Virginia, effective July 1, 2010, the Commissioner of Health shall assess and collect a fee of no more than $300.00 for an application for sanitary facilities, plan review, and initial certificate for other places where boats are moored.
4. Notwithstanding § 32.1-246, Code of Virginia, effective July 1, 2010, the Commissioner of Health shall assess and collect a fee of no more than $250.00 to be charged once every five years, for a renewal of certificate for other places where boats are moored.
5. Funds received pursuant to paragraph B., shall be deposited into the Marina Fund to support the Office of Environmental Health Services Marina Program.
C. 1. Notwithstanding §§ 28.2-803, 28.2-1206, and 62.1-44.15:6, Code of Virginia, effective July 1, 2010, the Commissioner of Health shall assess and collect a fee of no more than $600.00 for shellfish and crab meat dealer certifications.
2. Notwithstanding §§ 28.2-803, 28.2-1206, and 62.1-44.15:6, Code of Virginia, effective July 1, 2010, the Commissioner of Health shall assess and collect a fee of no more than $600.00 for Department of Environmental Quality National Pollutant Discharge Elimination System permit reviews.
3. Notwithstanding §§ 28.2-803, 28.2-1206, and 62.1-44.15:6, Code of Virginia, effective July 1, 2010, the Commissioner of Health shall assess and collect a fee of no more than $50.00 for Marine Resource Commission nonboat-related permit reviews.
4. Notwithstanding §§ 28.2-803, 28.2-1206, and 62.1-44.15:6, Code of Virginia, effective July 1, 2010, the Commissioner of Health shall assess and collect a fee of no more than $100.00 for Marine Resource Commission boat-related permit reviews.
5. Funds received pursuant to paragraph C., shall be used only to support the department's Division of Shellfish Sanitation.
D. Notwithstanding § 28.2-800, Code of Virginia, “Certificate of Inspection” means the certificate issued by the Commissioner of Health for an effective period not to exceed 12 months, to each person, firm, or corporation operating an establishment for the processing, handling or storage of shellfish or crustacea.
