"C.  Prior to the release of any Rail Enhancement Funds to CSX for I-95 Rail Corridor Improvements pursuant to Item 449.10, the Department and CSX shall execute an operating agreement that will provide for improved  and reliable passenger and freight rail operations in the corridor.  This agreement must include provisions for managing heat restrictions, including strategies for maintaining or enhancing the reliability of passenger rail services during periods of heat restriction.
D.  Any Plan entered into pursuant to an Agreement between CSX and the Department of Rail and Public Transportation for improved passenger and freight rail operations on the I-95 Rail Corridor as outlined in Item 450 subsection C, shall be approved by the Commonwealth Transportation Board prior to the release of any Rail Enhancement Funds to CSX. The Department shall inform the Senate Committees on Transportation and Finance and the House Committees on Transportation and Appropriations on the collaborative effort to improve rail operations on the corridor by December 15, 2008."

(This amendment requires the Commonwealth Transportation Board to approve the Plan between CSX and the Department of Rail and Public Transportation for addressing heat restrictions and other factors impacting passenger rail service on the I-95 corridor.)
