"M.  Out of the amounts appropriated for Crime Investigation and Intelligence Services, $15,100,000 the first year and $10,100,000 the second year from the general fund and 100 positions are provided to establish a Division of Legal Presence Investigation and Enforcement.  The division would be responsible for investigating any person's failure to provide proof of legal presence in the Commonwealth when required by law or when requested to do so by the Office of the Attorney General, any sheriff, any chief of police, a Commonwealth's attorney, or a grand jury.  The division is directed develop a memorandum of understanding with the U.S. Department of Homeland Security's Immigration and Customs Enforcement unit and to ensure that its officers are adequately trained to perform immigration functions contained in the memorandum of understanding."


Explanation
(This amendment provides for the addition of 100 state troopers to implement the provisions of House Bill 305, which creates a legal presence investigation and enforcement division. Investigations would be conducted into an individual's failure to produce evidence of legal presence when required by law or requested by the Attorney General, any sheriff, any chief of police, Commonwealth's attorney, or a grand jury. The division would also be directed to establish a memorandum of understanding with the U.S. Department of Homeland Security, Immigration and Customs Enforcement.)
