Page 253, line 40, after "locality.", insert:
"The Secretary shall establish an Implementation Work Group to prepare guidelines that shall be in place by July 1, 2009.  The Implementation Work Group shall include representatives from the Virginia Association of Counties, Virginia Municipal League, Virginia League of Social Services Executives, Virginia Association of Community Service Boards, and the Virginia Coalition of Private Providers.  The materials related to or used in by the Implementation Work Group shall be considered public documents under the Virginia Freedom of Information Act and not covered under the exemption for Governor’s working papers."  
Page 253, line 50, after "2008," strike "the" and insert:
"localities shall review their caseloads for those individuals who can be served by community based services and transition those cases to the community for services.  The".
Page 254, after line 1, insert:
The following shall be exempt from the provisions of Item 283.3.d.  Those needing services entering:
(1)  Under the Interagency Guidelines on Foster Care Services for Specific “Children in Need of Services” funded through the Comprehensive Services Act (CSA), effective December 3, 2007.
(2) Under an IEP adopted by a public school division.  
(3) Under an order by a Judge of the Juvenile & Domestic Relations Court directing residential services."

(This amendment requires the Secretary of Health and Human Resources to establish an implementation team to oversee guidelines on a system of financial incentives to localities to use community-based services in lieu of residential services for children in CSA. Language in the introduced budget raised the state share of funding in CSA for community-based services and lowered the state share of funding for residential services as an incentive to promote a system of community-based care for children in CSA. Language is added to require localities to review their caseloads for those individuals who can be served in the community and to transition these cases to the community for services. Language is also added to exempt certain CSA cases receiving residential services from the lower state share of funding as required in the introduced budget.)
