"There is hereby created on the books of the Comptroller a special nonreverting fund known as the Minimum Wage Enforcement Revolving Trust Fund.  Included in this item is $150,000 the first year and $150,000 the second year in special funds for the Minimum Wage Enforcement Revolving Fund as established herein.  The Department of Labor and Industry is authorized to deposit to the Fund any fees, civil penalties, costs, recoveries, or other moneys which from time to time may become available as a result of enforcement of Virginia's Minimum Wage Law, § 40.1-28.8 et seq., Code of Virginia.  The Department of Labor and Industry is also authorized to deposit to the Fund or to pay directly to private counsel obtained by the Department any attorneys' fees which from time to time may be obtained.  Any deposit to, and interest earnings on, the Fund shall be retained in the Fund, provided, however, that any amounts contained in the Fund that exceed $150,000 on the final day of the fiscal year shall be deposited to the credit of the general fund.  The Fund may be used to pay costs associated with enforcement of the Virginia Minimum Wage Act, § 40.1-28.8 et seq., Code of Virginia."

(This amendment establishes a special nonreverting fund, not to exceed $150,000, within the Department of Labor and Industry to support enforcement of Virginia's Minimum Wage Law.)
