A. Out of the amounts for Appellate Review shall be paid:
1. The annual salary of the Chief Justice, $158,514 from July 1, 2006, to November 24, 2006, $164,855 from November 25, 2006, to November 24, 2007, and $164,855 $169,801 from November 25, 2007, to June 30, 2008.
2. The annual salaries of the six (6) Associate Justices, each $148,682 from July 1, 2006, to November 24, 2006, $154,629 from November 25, 2006, to November 24, 2007, and $154,629 $159,268 from November 25, 2007, to June 30, 2008.
3. To each justice, $13,500 the first year and $13,500 the second year, for expenses not otherwise reimbursed, said expenses to be paid out of the current appropriation to the Court.
B. There is hereby reappropriated the unexpended balance remaining at the close of business on June 30, 2006, in the appropriation made in Item 26, Chapter 921, Acts of Assembly of 2005, in the item detail Other Court Costs and Allowances (Criminal Fund) and the balance remaining in this item detail on June 30, 2007.
C. Notwithstanding the provisions of § 19.2-163, Code of Virginia, the Executive Secretary of the Supreme Court may waive the maximum fee allowed for court-appointed counsel in certain cases, including but not limited to juveniles charged with an offense which would be a felony if committed by an adult, and award such fee as deemed appropriate. The presiding judge shall certify that the request for waiver is justified, but such waiver shall not be final until approved by the Executive Secretary. All waiver requests shall be submitted to the trial court through a detailed electronic voucher. Out of the appropriation for this Item, $9,000,000 the second year from the general fund is included for the additional costs resulting from such waivers. The Executive Secretary shall maintain a record of the requests for waivers, including but not limited to, the amounts requested and awarded, the circumstances justifying the waiver, and the jurisdiction of the cases involved.
