Page 271, after line 53, insert:
"TT.  The Department of Medical Assistance Services, in cooperation with the Department of Mental Health, Mental Retardation and Substance Abuse Services, the Virginia Association of Community Services Boards, the ARC of Virginia, and other stakeholders, shall jointly develop and submit for federal approval an amendment to  the home- and community-based waiver for persons with mental retardation to provide a person-centered, individualized support focus.  The amendments to the waiver shall, at a minimum, address the need to upgrade availability of therapeutic behavioral consultation, skilled nursing, medical and other specialized supports.  The amendments shall ensure that waiver services are equivalent to the services provided through intermediate care facilities for the mentally retarded (ICF-MRs).  In developing the amendments to the waiver, the department shall review successful models of waiver funded community supports used by other states to serve individuals with mental retardation  for potential application to Virginia.  Amendments to the waiver shall be submitted to the federal Centers for Medicare and Medicaid by June 30, 2006 with a goal of implementation by October 1, 2006.

(This language amendment requires the Department of Medical Assistance Services to work with the Department of Mental Health, Mental Retardation and Substance Abuse Services and interested stakeholders to develop and submit an amendment to the mental retardation (MR) waiver to provide a person-centered, individualized support focus and MR waiver supports that are equal to the level offered by ICF-MRs.)
