"D. The Director, Department of Planning and Budget, is hereby authorized to increase the nongeneral fund appropriation for this item to reflect the costs of administering the provisions of House Bill 527, 2006 Session of the General Assembly. Such amounts shall not exceed 18 percent of estimated total revenues generated by that legislation. Prior to making any adjustments to the department's appropriation for this activity, the Director, Department of Planning and Budget, shall report to the Chairmen of the House Appropriations and Senate Finance Committees on the amount of the appropriation adjustment and provide details on how funds shall be used, whether to expand department staff or to enter into a contract with an outside collection agency to administer the program."

Explanation
(This amendment authorizes the Department of Planning and Budget to increase the nongeneral fund appropriation for DMV to reflect the costs of collecting revenues generated by House Bill 527. These amounts are in addition to those appropriated for highway purposes in Item 443.10. The appropriation of the abuser penalties in that item included a reduction of 18 percent of assumed total revenues to account for potential collection costs.)

Authority: Title 46.2, Chapters 1 and 2, and § 46.2-697.1; Title 58.1, Chapters 17, 21, and 24, Code of Virginia.

A. The Department of Transportation shall reimburse the Department of Motor Vehicles for the operating costs of the Fuels Tax Evasion Program.

B. The Department of Motor Vehicles shall retain $3,200,000 in the first year and $6,400,000 in the second year from the Department of Motor Vehicles' Uninsured Motorists Fund to effect its information technology initiatives and implementation of the federal Real ID Act. These amounts shall be from the share that would otherwise have been transferred to the State Corporation Commission pursuant to § 46.2-710, Code of Virginia.

C.1. In addition to all other fees required by law, there is imposed a one-dollar annual fee on the registration by the Department of Motor Vehicles of each pickup or panel truck and each motor vehicle, to be charged and collected at the time of registration under subdivisions A1 through A12 of § 46.2-694, Code of Virginia.

2. The Commissioner of Motor Vehicles shall cause appropriate language and symbols calling attention to the 400th anniversary of the Jamestown settlement in 2007 to be placed on all standard license plates issued by the Department of Motor Vehicles. In each fiscal year, the funds collected from the one-dollar annual registration fee pursuant to paragraph C.1 of this Item shall be applied first to cover the costs of the Department of Motor Vehicles in administering the commemorative license program. The next $3,000,000 in funds collected under the provisions of paragraph C.1 of this Item shall be paid to the Virginia 400th Anniversary Fund to support educational programs sponsored or approved by the Jamestown-Yorktown Foundation, community programs, facility operations and other activities related to the planning, promotion and commemoration of the 400th anniversary of Jamestown and Virginia in 2007. Any funds in excess of $3,000,000 but not greater than $6,000,000 collected under the provisions of paragraph C.1 of this Item shall be paid as follows: i) one-third of the excess amount shall be deposited to the Virginia 400th Anniversary Fund to be used for the same purposes specified above for the Fund, and (ii) one-third of the excess amount shall be deposited to the special fund of the Department of Motor Vehicles to assist with the costs of implementing Chapter 817 and Chapter 819 as enacted by the 2003 Session of the General Assembly, and (iii) one-third shall be deposited to a special fund of the Virginia Tourism Authority to advertise and market the Jamestown 2007 Commemoration. Any funds in excess of $6,000,000 collected under the provisions of paragraph C.1. of this Item shall be deposited to the Virginia Land Conservation Fund to be distributed pursuant to § 10.1-1020, Code of Virginia, and the provisions of Item 359, paragraph F, of this act.

3. The Jamestown-Yorktown Foundation shall prepare an operating plan for the use of any monies paid into the Virginia 400th Anniversary Fund pursuant to the provisions of paragraphs C.1 and C.2 of this Item and receive the Governor's approval of such operating plan prior to the allotment of such monies for expenditure.

4. It is the intent of the General Assembly that the provisions of this Item to support the special license plate program and other activities in commemoration of the 400th anniversary of the Jamestown settlement and Virginia not be continued past December 31, 2007.

5. Effective January 1, 2008, funds collected under the provisions of paragraph C.1 of this Item shall be used to support the information technology initiatives of the Department of Motor Vehicles and implementation of the federal Real ID Act in the Commonwealth. Any funds in excess of $6,000,000 collected under the provisions of paragraph C.1. of this Item shall be deposited to the Virginia Land Conservation Fund to be distributed pursuant to § 10.1-1020, Code of Virginia, and the provisions of Item 359, paragraph F, of this act.
