Page 264, after line 47, insert:
"BBB.1.  Notwithstanding any other provision of law, the Administrator shall ensure that the operation of any program of prior authorization governing program recipients' access to medications prescribed by their physicians meets criteria to ensure continuity of care and addresses product substitution.
2.  For a drug prescribed for a recipient that is subject to prior authorization, the pharmacist shall receive payment for dispensing of such drug without seeking authorization so long as the pharmacist confirms that (i) the prescription is a refill or renewal or reauthorization in the form of a new prescription of the same drug for the same recipient or (ii) the prescription has been prescribed to treat an ongoing condition, or has been filled for the same drug within the preceding 90 days, or  (iii) the prescription is for a recurring acute condition, which has been filled with the same drug within the previous 12 months.
3.   For a drug prescribed for a recipient that is subject to prior authorization, the pharmacist shall receive payment for dispensing of such drug when the prescriber has indicated on the face of the prescription "dispense as written" in handwriting or other appropriate form for electronic prescription.  Further, the pharmacist may not (i) substitute another drug without the express permission of the prescriber, (ii) be required to seek prior authorization from the state or any benefit administrator, or (ii) be required to telephone or otherwise confirm that the physician does not wish to substitute another medication.  
4.  When the prescriber has failed to indicate on the face of the prescription "dispense as written" or "DAW" in no instance shall the drug be switched without the express authorization of the prescriber to change the original prescription to a different medication for the patient."


Explanation
(This amendment restricts the use of prior authorization for prescription drugs and ensures that pharmacists are paid for dispensing prescriptions when directed to dispense as written without seeking prior authorization.)
