"BBB.1.  The Department of Medical Assistance Services shall amend the State Plan for Medical Assistance Services to eliminate the current emergency room claims pend and review process.  The Department may adopt retrospective audit procedures for emergency claims similar to those used by private health care insurers.
2.  The  Department of Medical Assistance Services shall also amend the State Plan for Medical Assistance Services to provide increased reimbursement to physicians delivering services to recipients in hospital emergency rooms effecting an increase of two  percent above the fiscal year 2004 level of reimbursement effective July 1, 2004, and an additional two percent effective July 1, 2005.  Such amendments to the State Plan shall become effective within 280 days or less from the enactment of this act."


Explanation
(This amendment increases the Medicaid reimbursement for emergency room physicians by two percent each year in the 2004-06 biennium. In addition, it restricts the Department of Medical Assistance Services from pending and holding hospital emergency room claims prior to payment. However, the Department may continue to retrospectively review and audit claims to ensure payments are appropriate and accurate.)
