As a condition of this appropriation, the Department of Medical Assistance Services, in collaboration with stakeholders, shall develop an application for a home- and community-based waiver for mental retardation services that includes the following elements:
(i) Community services boards and behavioral health authorities shall remain as the single point of entry for waiver services and have the sole responsibility of case management and care coordination, consistent with the December 20, 2000, report by the Department of Mental Health, Mental Retardation and Substance Abuse Services (DMHMRSAS) on case management, care coordination, and services.  As the local managers of services, the community services boards and behavioral health authorities shall ensure local accountability for publicly funded services, continuity of care, census management and discharge planning with state facilities, and quality assurance of services provided.  Additionally, direct services should be available to consumers who choose them.
(ii) The home- and community-based waiver program shall be operated by the DMHMRSAS under the supervision of the Department of Medical Assistance Services.
(iii) One state agency shall maintain a statewide waiting list with statewide criteria for individuals to be served and removed from the waiting list.  The community services boards and behavioral health authorities shall manage the waiting list at the local level by determining who should be served from the waiting list in accordance with the criteria.  The community services boards and behavioral health authorities shall be assigned a waiting list allocation each year so that they can plan ahead to respond to consumer choice and compatibility of services.
(iv) Funding and slots for an increase of at least 750 new individuals to be served per year should be provided.
(v) The Department of Medical Assistance Services shall present the proposed waiver application to the Joint Behavioral Health Care Commission for its review prior to submission to the Health Care Financing Administration. The report should include an analysis of the impact of the proposed waiver and an implementation plan to include provider development, rate setting methodologies, and steps to ensure a smooth transition."


Explanation
(This amendment specifies elements to be included in any revision to the current home- and community-based waiver for mental retardation services. It retains elements of the waiver that have contributed positively to the administration of the program in the past such as providing DMHMRSAS operational responsibility for the waiver and retaining the community services boards as the single point of entry. It also provides for review of the proposed waiver by the Joint Behavioral Health Care Commission prior to submission to the federal government for approval.)
