Page 461, after line 37, insert "In accordance with the provisions of §6 of the fourth enactment of Chapters 1019 and 1044 of the Acts of Assembly of 2000, the Commonwealth Transportation Board may expend the general funds appropriated in this paragraph for highway projects within the same construction district upon approval of the action through a  resolution of the Commonwealth Transportation Board.  Such resolution shall be transmitted to the Chairmen of the Senate Finance and House Appropriations Committee within five days of adoption.  In expending general funds on highway projects not specifically named in §6 of the fourth enactment of Chapters 1019 and 1044 of the Acts of Assembly of 2000, the Department of Transportation shall practice due diligence in accounting for general fund expenditures in the construction program.  It is the intent of the General Assembly that any general funds unexpended at the end of the first year shall be reappropriated for expenditure in the second year.
2)  In accordance with the provisions of §1 of the fourth enactment of Chapters 1019 and 1044 of the Acts of Assembly of 2000, as amended within this paragraph, $16,425,038 in the first year shall be appropriated to the mass transit assistance program for a statewide new transit vehicle and equipment program to be administered by the Department of Rail and Public Transportation.  In addition to the general fund appropriation, $6,646,962 in the first year from federal highway funds shall be appropriated to this program with an additional $4,000,000 in federal funds allocated to the Virginia Railway Express by action of the Commonwealth Transportation Board.  No funds appropriated to the statewide new transit vehicle and equipment program shall be allocated or expended by the Commonwealth Transportation Board for teleworking or employee shuttles.   The statewide new transit vehicle and equipment program shall be a competitive grant program with no less than $1,300,000 for the Hampton Roads Innovative Regional Bus Plan in the first year and no less than $1,300,000 for the Greater Richmond Transit Company (GRTC) new or extended bus service in each fiscal year.  The Program shall include both suburban and rural small transit systems and be on a statewide basis.
3)  In accordance with the provisions of §2 of the fourth enactment of Chapters 1019 and 1044 of the Acts of Assembly of 2000, as amended within this paragraph, $23,000,000 shall be appropriated to the Virginia Airports Revolving Loan Fund pursuant to Chapter 2.1 (§5.1-30.1 et seq.) of Title 5.1 of the
Code of Virginia.
4)  No general funds shall be appropriated in the second year to the purpose specified in §3 of the fourth enactment of Chapters 1019 and 1044 of the Acts of Assembly of 2000.
5)  In accordance with the provisions of §4 of the fourth enactment of Chapters 1019 and 1044 of the Acts of Assembly of 2000, $2,000,000 in general funds in the first year shall be designated to the Smithsonian Institution for the "Virginia Appropriation" pursuant to the requirements of the Memorandum of Understanding between the Commonwealth and the Smithsonian Institution concerning the National Air and Space Museum Extension.
6)  In accordance with the provisions of §5 of the fourth enactment of Chapters 1019 and 1044 of the Acts of Assembly of 2000, $1,500,000 in general funds in the first year and $852,000 in the second year shall be appropriated to the water transportation system planning program administered by the Virginia Port Authority to be used as matching funds required by the Water Resources Development Act of 1986 (Public Law 99-262), as amended, for a study of the eastward expansion of the federally owned Craney Island Dredged Material Management Area.  In addition, $500,000 in general funds in the first year and $200,000 in the second year shall be used to begin the dredging of the inbound channel of the Norfolk Harbor Channel."

Explanation
(This amendment fulfills a request by the Administration to allow general funds appropriated to highway construction to be used on other highway construction projects if they cannot be used on those named in §6 of the fourth enactment of the Virginia Transportation Act of 2000; to reflect that Route 288 projects included in the Act as general fund projects have now been turned over to a private firm in accordance with the Public-Private Transportation Act, meaning that comprehensive agreement and contract allow the project to be completed approximately 3 years earlier than thought when the Virginia Transportation Act of 2000 was enacted; and to reflect legislative intent with the creation of a short-term financing program in a separate amendment as well as regard for the administrative action to direct funds to teleworking even though the General Assembly defeated such a proposal. It also reduces the general fund appropriation to the Virginia Aviation Revolving Loan Fund reflecting the funds not deposited to a debt service reserve account. The amendment also restates legislative intent regarding the other general fund appropriations made in the VTA.)
