"P.  In the second year, $56,800,385 is to be divided equally between secondary construction and urban construction and allocated in accordance with the allocation formulas in §33.1-23.3 and §33.1.23.4 of the
Code of Virginia.  The funding sources for such additional allocations in the second year are $22,621,385 in increased liquidated damages revenues resulting from the passage of SB 1097 and $34,179,000 in Minimum Guarantee Equity Funds as specified in Item 506 of this Act.  By resolution of the local governing body receiving such additional allocation, these funds may be allocated to maintenance, construction, and/or mass transit activities.  If no such resolution is received by the Commonwealth Transportation Board, such funds shall be allocated to highway construction projects in that locality.  No allocation, expenditure, or use of the funds specified in this paragraph shall be considered in allocating highway maintenance and construction funds under §33.1-23.1 of the
Code of Virginia or apportioning Transportation Trust Fund funds under §58.1-638, but shall be in addition thereto."


Explanation
(This amendment provides increased funding in the second year to the secondary and urban construction fund from a combination of new revenues generated by the passage of SB 1097 and the direction of discretionary federal funds formally allocated by the Commonwealth Transportation Board. The amendment provides that localities can use the increased funding for maintenance, construction or mass transit activities as expressed in a resolution by the local governing body.)
