"XX.  Beginning July 1, 2001, any nursing facility with a traumatic brain injury special care unit approved by the Department of Medical Assistance Services that provides care in such special unit for individuals who have acquired brain injuries resulting from non-congenital causes other than direct trauma, such as cerebrovascular accidents, brain tumors, prolonged seizure activity, anoxia, and neurotoxicity, and who (i) are not older than sixty years of age at the time of admission, (ii) are ambulatory, and (iii) exhibit abusive, aggressive, or disruptive behavior as the result of confused awareness of their circumstances as demonstrated by a score within a range of IV and VII on the Ranchos Scale, shall receive from the Department of Medical Assistance Services for the care of such individuals with acquired brain injuries fixed per-day Medicaid payments that are equal to the fixed per-day Medicaid payments applicable to the care in such special care unit of individuals with traumatic brain injuries.  The total reimbursement differential for such care shall not exceed $102,930 per year for all qualified individuals."


Explanation
(This amendment would increase nursing home payments for persons with acquired brain injuries to the rate provided for persons with traumatic brain injuries.)
