"2. The Department of Medical Assistance Services shall develop this new  mental retardation waiver with the full involvement of  the Department of Mental Health, Mental Retardation and Substance Abuse Services.  Further, the Department shall establish a stakeholder advisory committee to provide input into and comment on drafts of this new waiver.  This committee shall include representatives of consumers and family members, community services boards, behavioral health authorities, private providers, advocacy groups, and local governments.  This new waiver shall continue the current Department practice of restricting the provision of targeted mental retardation case management to community services boards and behavioral health authorities.  The waiver shall recognize the statutory role of community services boards and behavioral health authorities as the single point of entry into the publicly funded mental retardation services system while ensuring that recipients have the greatest possible choice of service providers.  This new waiver shall include rates that reflect the actual costs of providing services, to ensure that services are available statewide and that consumers have as much choice as possible among providers.  The waiver also shall include provisions for the establishment and maintenance by community services boards and behavioral health authorities of local or regional waiting lists for services. The Department shall report on the proposed new waiver to the Chairmen and the Human Resources Subcommittees of the House Appropriations and Senate Finance Committees periodically and prior to submitting it to the Health Care Financing Administration for approval. "


Explanation
(This amendment clarifies the intent of the General Assembly for the roles of the Department of Medical Assistance Services and the Department of Mental Health, Mental Retardation and Substance Abuse Services and other stakeholders in the development of a revised home- and community-based waiver for mental retardation services. Language specifies that current practices and law regarding the role of the community services boards shall remain key components of a new waiver. Language is added to require the Department of Medical Assistance Services to submit the waiver to the money committees of the General Assembly for review prior to submitting it to the federal government for approval.)
